According to Public Health Nuisances Lincoln City Air Pollution Code November 2012, there are restrictions and guidelines to constructing a backyard fire pit defined as such that: “combustion products are discharged directly into the air without passing through an appropriate pile, pipe, or chimney. This will include burning wood in a metal fire pit, a chimney, fire tables, an independent fireplace, homemade fire pits made of a gardening block, or beneath ground level pits”.

Moreover, every time smoke from the fire travels on neighboring property and affects the health and safety of neighbors it is a violation of air pollution code.

As such you can only burn dry and clean wood. You can’t burn leaves, pine needles, and grasses, recently cut branches, brush, or any kind of household garbage.

The fire can’t be greater than 8 cubic feet or more than 3 meters in diameter.

All fire pits must be placed at a minimum of 25 meters from any building or flammable material and you must have fire extinguishing materials (water, dirt, sand, etc.) available.
